What Happens if My Work Permit Expires While I Am Still Employed?

For many immigrants in the United States, the work permit, or EAD, is the key to working legally, supporting their families, and building a more stable future. However, a common fear is: what happens if my permit expires while I am still working? This article explains your rights, risks, and steps to take if you are waiting for renewal of your EAD under programs such as TPS, asylum, SIJS, or U visa.

que pasa si mi permiso de trabajo expira mientras sigo en el empleo

1. What does it mean for your work permit to expire?

When the EAD expires, you no longer have a valid document showing work authorization. Even if you applied for renewal on time, legally you cannot continue working if your EAD is expired unless certain automatic extensions apply.

2. Automatic extensions of work permits

The government recognizes that immigration processes can be slow, so an automatic extension of up to 540 days exists for certain applicants. This means that if you requested renewal on time, you may continue working legally even if your physical card has expired. Cases that may qualify include pending asylum applicants, people with TPS, people with pending U visa cases, and youth with SIJS in the adjustment process. Note: not every EAD category qualifies. It is important to review the categories USCIS includes in the automatic extension.

3. Risks of working with an expired permit without a valid extension

If your EAD already expired and you do not have an automatic extension, the employer, by law, cannot keep you working. You could face labor issues if you continue employment. In a future immigration review, unauthorized work could be used against you.

4. What should workers waiting for renewal do?

Renew early. Ideally, send the request 180 days before expiration. Review whether you qualify for the automatic extension. Keep your renewal receipt, Form I-797C, and present it together with your expired EAD to your employer. Inform your employer correctly, because many employers do not know about the automatic extension. Providing the receipt along with the expired permit may be enough to update your I-9 documents. Consult an immigration attorney because each case is different, and it is important to confirm whether you are covered.

5. Practical tips

Keep copies of everything you send to USCIS. Track your case online so you do not miss updates. Do not wait until the last minute; delays are common and could leave you temporarily without authorization.

If your work permit expires, that does not automatically mean you are unprotected. Many immigrants under TPS, asylum, SIJS, or U visa have the automatic extension of up to 540 days, giving them security to continue working while the new card arrives. However, each situation is different. The best decision is always to consult with an immigration attorney who can guide you according to your case.
